Latest News: Stronger Mortgage Relief Now in Effect

On January 6, 2026, Governor Newsom announced additional relief from major national lenders to offer additional forbearance of up to 90 days to LA fire survivors, subject to investor approval and consistent with the terms of the Governor’s January 2025 agreement.  Bank of America is now offering qualifying customers up to 2 additional years of forbearance, beyond the initial 12-month period, for those who plan to rebuild their home.

The DFPI has now secured agreements of additional forbearance of up to 90 days from approximately 160 institutions that have renewed their commitment to extend relief to those still recovering from the devastating fires.

In addition, Governor Newsom announced a major expansion of the state’s CalAssist mortgage relief program.

California Law: Assembly Bill 238

On September 22, 2025, Governor Newsom signed into law AB 238, which requires a mortgage lender or servicer to provide up to 12 months of mortgage forbearance to a borrower experiencing financial hardship due to the wildfire disaster. This bill deepens homeowner protections by expanding relief and creating enforceable legal requirements.

AB 238 Key Provisions

  • An initial 90-day mortgage payment forbearance period subject to extension in 90-day increments up to a maximum of 12 months. This allows the lender to work out a suitable repayment plan with the borrower.
  • Prohibitions on mortgage lender or servicer from requiring a lump sum or “balloon” payments, if the mortgage was current  on the residential mortgage loan when the borrower entered forbearance.
  • No late fees or charging a default rate of interest during the forbearance period.
  • No initiations of foreclosures or evictions if the borrower is performing according to the terms of the forbearance agreement.
  • No reporting to credit agencies that the mortgage is in forbearance, or furnishing information during the forbearance period indicating that the payments are in forbearance.
  • AB 238 also clarified that mortgage servicers are not required to take actions that would require the mortgage lender or servicer to breach the terms of an existing contract with the investor that owns the residential mortgage loan.

AB 238 builds upon the 2025 announcement that the state has worked with major lenders to offer mortgage relief to LA firestorm victims. The following federally chartered institutions committed to offering relief: Bank of America, Citi, JPMorgan Chase, U.S. Bank, Wells Fargo, and BMO Bank. In addition, the DFPI confirmed additional commitments from more than 420 financial institutions.

Rights for Renters

According to the L.A. County Department of Consumer and Business Affairs (DCBA), if a rental unit has been completely destroyed in a disaster, the rental agreement is void under California law. This means you are no longer obligated to pay rent and the landlord is no longer required to provide you housing. Renters may have ongoing obligations if their unit is partially destroyed or suffers only minor damage, in which case it is important to seek legal advice from an attorney before stopping rent payments. You may wish to consult with the DCBA, a legal aid, or a tenant’s attorney for more information about your rights and remedies.

What is CalAssist Mortgage Fund?

CalAssist Mortgage Fund is a state program that provides much-needed relief from mortgage payments for displaced families whose homes were destroyed or left uninhabitable by a California disaster such as the Los Angeles wildfires or floods.

On October 22, 2025, CalAssist increased its income limits, which allow thousands more homeowners to qualify for relief.
