Spanish Royal Decree 1312/2024: Frequently Asked Questions

The Royal Decree 1312/2024, of December 23, 2024, regulating the procedure for the National Registry and the creation of the Single Digital Entry Point for the collection and exchange of data related to short-term rentals entered into force on January 2, 2025, although its provisions fully apply from July 1, 2025. The Decree establishes a procedure for obtaining a national registration number to be assigned to each property or part thereof intended to be rented separately (“Royal Decree 1312/2024”).

When will the obligations under Royal Decree 1312/2024 be enforceable?

The obligations under the Royal Decree 1312/2024 have been enforceable since July 1, 2025.

For whom does the Royal Decree 1312/2024 define obligations?

It establishes obligations for both hosts and online platforms, such as Airbnb, offering or displaying short-term rentals.

A host, for the purposes of this regulation, is defined as a natural or legal person who, for remuneration, provides or intends to provide short-term rental accommodations through an online platform, whether on a professional or non-professional basis, on a regular or occasional basis.

How is "short-term rentals" defined? Does it also include seasonal rentals and private rooms?

Short term rental is defined as follows: “The short-term rental of one or more units, for tourism or otherwise, in exchange for compensation, whether professional or non-professional, on a regular or irregular basis, shall be subject to the regulation of seasonal leasing as per Article 3.2 of Law 29/1994, of 24 November, on Urban Leases, as well as the applicable regulations concerning the leasing of vessels subject to Regulation (EU) 2024/1028 of the European Parliament and the Council, of 11 April 2024, the applicable regulations on tourist rentals and their sanctioning regime established by autonomous communities and local entities, as well as, where appropriate, the regulations related to the protection and defense of consumers and users.”

As stated above, seasonal rentals (the so-called “alquiler de temporada”, as defined in the Law 29/1994, of 24 November, on Urban Leases) are included in this definition and therefore would be under the obligation to apply for a national registration number and display it on the listing page.

Rooms are also considered to be a “unit” under the definition above as Royal Decree 1312/2024 in article 2 (b) clarifies that it is applicable to a “furnished accommodation, whether or not it affects the entirety of it”.

Which are the obligations under Royal Decree 1312/2024?

  • Hosts must obtain a registration number in order to advertise their properties on the online platforms (such as Airbnb).
  • Hosts are required to update the information provided about their properties when it changes to ensure it is accurate and remains in compliance.
  • Hosts are required to respond to requests for information they may receive from the competent authorities concerning their properties.

What information must be provided to obtain the registration number?

The specific address of the unit and its cadastral reference, the type of unit and the maximum number of guests it can accommodate. The host will also provide documentation of compliance with regional and/or local requirements where the property is located (when applicable).

Information about the host, whether an individual or a legal entity, is required as well.

How can I get the registration number?

Through a registration procedure which you can start from here. The steps to follow are:

  1. Fill out the appropriate online web form;
  2. Download the PDF of the completed form;
  3. Make a new submission from the online submission service, selecting the type of operation "Assignment of the Rental Registration Number for short-term rentals" and attaching the PDF together with the complementary documentation requested.

What happens if there is incorrect information in the application?

If deficiencies are found in the application or documentation and the host does not correct them within seven business days, the registration number will be suspended and Airbnb will be required to remove or disable listings associated with that number.

How will I report the national registration number to Airbnb?

All properties located in Spain have a specific field on Airbnb to include the national registration number they have been assigned.

If I am not resident in Spain, do I have to obtain a registration number?

Yes, short-term rental accommodations (including seasonal rentals and rooms) that are located in Spain must obtain and display this national registration number in order to be advertised on online platforms.

What happens if I do not obtain the registration number?

According to Royal Decree 1312/2024, short-term rental accommodations (including seasonal rentals and rooms) will need to include the national registration number in order to be marketed through online platforms. Airbnb will ensure that hosts provide the registration number and that it is clearly displayed on their listings before allowing them to be offered on its platform.

Also, Airbnb will have to remove or disable listings that are linked to a suspended or withdrawn registration number.

Is it free to get a registration number?

No. The registration fee is 27 euros (taxes not included).

Which registration number should I provide when advertising a listing in Airbnb?

Airbnb has provided two distinct fields to include national and/or regional registration numbers, where applicable (or claim exemption).

Therefore, you must display your national registration number, if subjected to national registration obligations, in your listing’s national registration field or claim an exemption. If you have more than one national registration number, be sure to include the one that refers to your most common activity (tourist, seasonal, etc.) and the other one in your listing description.

As for regional numbers, use the regional field to include, when applicable, or claim exemption.
