The Royal Decree 1312/2024, of December 23, 2024, regulating the procedure for the National Registry and the creation of the Single Digital Entry Point for the collection and exchange of data related to short-term rentals entered into force on January 2, 2025, although its provisions fully apply from July 1, 2025. The Decree establishes a procedure for obtaining a national registration number to be assigned to each property or part thereof intended to be rented separately (“Royal Decree 1312/2024”).
The obligations under the Royal Decree 1312/2024 have been enforceable since July 1, 2025.
It establishes obligations for both hosts and online platforms, such as Airbnb, offering or displaying short-term rentals.
A host, for the purposes of this regulation, is defined as a natural or legal person who, for remuneration, provides or intends to provide short-term rental accommodations through an online platform, whether on a professional or non-professional basis, on a regular or occasional basis.
Short term rental is defined as follows: “The short-term rental of one or more units, for tourism or otherwise, in exchange for compensation, whether professional or non-professional, on a regular or irregular basis, shall be subject to the regulation of seasonal leasing as per Article 3.2 of Law 29/1994, of 24 November, on Urban Leases, as well as the applicable regulations concerning the leasing of vessels subject to Regulation (EU) 2024/1028 of the European Parliament and the Council, of 11 April 2024, the applicable regulations on tourist rentals and their sanctioning regime established by autonomous communities and local entities, as well as, where appropriate, the regulations related to the protection and defense of consumers and users.”
As stated above, seasonal rentals (the so-called “alquiler de temporada”, as defined in the Law 29/1994, of 24 November, on Urban Leases) are included in this definition and therefore would be under the obligation to apply for a national registration number and display it on the listing page.
Rooms are also considered to be a “unit” under the definition above as Royal Decree 1312/2024 in article 2 (b) clarifies that it is applicable to a “furnished accommodation, whether or not it affects the entirety of it”.
The specific address of the unit and its cadastral reference, the type of unit and the maximum number of guests it can accommodate. The host will also provide documentation of compliance with regional and/or local requirements where the property is located (when applicable).
