Besides these laws, municipalities may have approved zoning regulations and/or restrictions that can impact your activity. Regional regulations

The Regional Government of Andalusia has specific regulations for tourist accommodations. According to the regional decree on the matter, “tourist accommodations” are understood to be those homes within the Autonomous Community of Andalusia that are: equipped for immediate use and located in buildings where accommodation services are regularly offered in exchange for a price and for tourism purposes.Tourism purposes will be presumed when the property is advertised or promoted through tourism channels (including travel agencies, companies that mediate or organize rentals, and sites allowing actual bookings).

Tourist accommodations in Andalusia may be offered either as an entire place (single unit) or by rooms, meaning that both are subject to obligation requirements specified below. 

All tourist accommodations rented out for less than two (2) consecutive months for tourist purposes and to the same guest must comply with the obligations and requirements foreseen in the regulation mentioned above. Otherwise, it will fall under a different category of accommodation, such as a “seasonal rental.”

Regional registration requirements

In Andalusia, you need to register any accommodation that you plan to offer as a tourist accommodation, either as an entire property or by rooms (within the Tourism Register of Andalusia). As part of the process, you‘ll first need to submit a statement of responsibility to the Tourism Council that declares compliance with current regulations and any other requirements foreseen at regional and local levels. You‘ll also need to provide the expected calendar availability of each tourist accommodation (either all year or specific months).

After you successfully complete the registration process, a registration number will be assigned to your tourist accommodation (Example: VFT/HU/00000).

National registration requirements

In order to host in Spain, you may have an obligation to obtain a national registration number within the Property Registry and display it when you list your properties on Airbnb.

Advertising requirements

Andalusia requires you to display your registration number on any form of advertisement for your tourist accommodations, including Airbnb. There’s a field that you can use to include your registration number in the Listing details section.
