Regional regulations

The Regional Government of the Balearic Islands has specific regulations for tourist accommodations. According to its tourism law, a “tourist accommodation” (“estancias turísticas en viviendas”) are those temporarily rented for short term periods. Tourist accommodation is presumed to be commercialized when made available for immediate use and there is no evidence that the purpose is other than tourism.

Tourist accommodations in the Balearic Islands will need to be offered as an entire place (single unit).

All tourist accommodations rented out for thirty (30) days or less must comply with the obligations and requirements foreseen in the regulation mentioned above. Otherwise, it will fall under a different category of accommodation, such as a “seasonal rental.”

Also, the Balearic Islands allow the rental of the primary residence when carried out by an individual and for a period not exceeding 60 days per year. Please take into account local provisions and requirements in order to carry out this type of rental.

Regional registration requirements

In Mallorca, you need to register your tourist accommodation within the Mallorca Tourism Registry. As part of the process, you will first need to submit a statement of responsibility (DRIAT) to the General Directory of Tourism that declares compliance with the current regulations and any other requirements foreseen at regional and local levels. When doing so, please note that some areas have been declared not unsuitable for the commercialization of tourist accommodation at local level.

After you successfully complete the registration process, a registration number will be assigned to your tourist accommodation (Example:VT-0000).

National registration requirements

In order to host in Spain, you may have an obligation to obtain a national registration number with the Property Registry and display it when listing your properties on Airbnb.

Advertising requirements

Mallorca requires you to display your registration number, as well as the conditions regarding the reservation policy, on any form of advertisement for your tourist accommodations, including Airbnb. There’s a field you can use to include your registration number in the Listing details section.
