1. APPLICATION. 

If you reside in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Vermont, Virginia, or Washington, or are otherwise protected by privacy or consumer health data laws in those jurisdictions, this United States Privacy Supplement applies to you and supplements the Airbnb Privacy Policy.

Consistent with applicable law, you can exercise any of your consumer privacy rights by contacting us by email at dpo@airbnb.com or by visiting the link here. We will not discriminate or retaliate against you for exercising any of your privacy rights, although fulfilling some requests might affect the functionality or availability of our service or features. Any differences in the services are related to the personal information provided.

2.1 Verification. 

Please note that you may need to verify your identity or provide more information about your request before further action is taken to respond to your request. As part of this process, you may be required to provide personal information, such as your name, state of residence, phone number, or email address associated with your account, and/or details from your reservation history, to confirm your identity based on details we have about you.

2.2 Authorized Agent. 

Consistent with applicable law, you may designate an authorized agent to make a request on your behalf. When you designate an authorized agent to make a request on your behalf, we may require that: (i) the agent provide proof that you gave the agent signed, written permission to submit the request, (ii) you verify your identity directly with us and confirm the validity of the request, and/or (iii) you directly confirm with us that you provided the authorized agent permission to submit the request.

2.3 Appeal a Privacy Rights Request Denial. 

To appeal a refusal to take action on your request, please see the instructions in our response to your request or submit your appeal in writing by contacting dpo@airbnb.com with the subject “Appeal of Consumer Rights Request.”

3. YOUR RIGHTS.

3.1 Right to Access and Know. 

You may access some of your personal information in your Airbnb account. You may also submit a request:

  • to access the personal information that we have collected about you,
  • for more information about our privacy practices,
  • for additional information about the categories of personal information we collect, the sources of the personal information, our purposes for processing personal information, and the types of parties we share personal information with, and
  • for more details about the third parties with whom we share personal information.

3.2 Right to Delete. 

You may access some of your personal information in your Airbnb account. You may also submit a request to delete your personal information.

3.3 Right to Correct. 

You may correct some of your personal information in your Airbnb account. You may also ask us to correct inaccuracies using the request process. Consistent with applicable law, you may submit a verifiable consumer request to correct inaccuracies in your personal information held by Airbnb.

3.4 Right to Opt Out. 

3.4.1 Opt Out of Personal Information Selling, Sharing, and Targeted Advertising. 

We may share personal information with third parties to perform certain advertising, marketing, and analytic services, which under California and other U.S. consumer privacy laws could be characterized as “selling,” “sharing,” or “targeted advertising.” We are not data brokers and we do not put personal information on the open market. You may opt out of such processing by visiting the link here.

3.4.2 Opt-Out Signals.

We strive to honor opt-out preference signals where required by applicable law. You may opt out by enabling a legally recognized universal opt-out signal, such as the Global Privacy Control, when visiting our website. When we detect an opt-out signal, we will make reasonable efforts to honor it. Regardless of whether you are logged in to your Airbnb account or not, your opt-out may only apply to the specific browser, device, or technology that you used at the time of selecting to opt-out. We do not respond to “Do Not Track” signals.

3.4.3 Opt Out of Profiling that Results in Legal or Similarly Significant Effects or Automated Processing.

We do not process personal information for profiling or automated decision making that results in legal or other significant effects on you. If our practices change in the future, we will provide legally required notice, detailing our use and your rights, at that time.

3.4.4 Opt Out of Processing or Limit Use and/or Disclosure of Sensitive Personal Information. 

Some personal information we collect may be considered sensitive information under applicable laws, including precise geolocation data. We do not knowingly process the personal information of individuals younger than 18. We also do not use or disclose sensitive personal information for purposes to which the right to limit use and disclosure applies in California.

4. OTHER INFORMATION.

4.1 Withdrawing Consent. 

If we are processing your sensitive personal information based on your consent, you can withdraw your consent at any time by adjusting your relevant device permissions to restrict that data collection or by emailing dpo@airbnb.com and specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal.

4.2 De-Identification. 

When we de-identify personal information, we commit to maintain and use the personal information that we de-identify (or have received in de-identified form) in de-identified form and will not attempt to re-identify it.

4.3 California Shine the Light Requests. 

California residents may request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the prior calendar year, as well as the types of personal information disclosed to those third parties.

4.4 Information About California Consumer Requests. 

You can find information about consumer requests we received and processed under the California Consumer Privacy Act during the previous calendar year here.

5. CONSUMER HEALTH DATA NOTICE.

This Consumer Health Data Notice applies to consumer health data that Airbnb collects when you use the Airbnb Platform.

5.1 What Is Consumer Health Data. 

“Consumer health data” refers to personal information that can identify your past, present, or future physical or mental health status.

5.2 How We Collect Consumer Health Data.

5.2.1 Personal Information You Provide. 

We typically collect consumer health data directly from you when you provide this type of data to us. For example, when you book certain Airbnb Services or Experiences, your Host or Airbnb will ask you for health-related details to help accommodate your specific requirements. You might also voluntarily choose to give us health details that we do not ask for, such as through your customer service outreach. We may get the precise location of activities you book, including health-related activities, such as where you get a massage or book a personal trainer session.

5.2.2 Third-Party Tracking Technologies. 

We use third-party tracking technologies on the Airbnb Platform, as described in our Cookie Policy. These tracking technologies should not collect consumer health data over time or across websites when you use the Airbnb Platform.

5.3 Consumer Health Data We Collect. 

Depending on the type of booking you make, we may ask you for one or more of the following types of consumer health data relevant to your booking:

  • health conditions and treatment status
  • dietary restrictions and allergies
  • prescription and over-the-counter medications taken
  • symptoms and current general health status

We may also obtain the following consumer health data from you, your booking, your activities on the Airbnb Platform, and third parties:

  • precise location data that may reveal where you get health-related services you book with us
  • data that indicates you are interested in health-related services, such as masseuse and personal training services.

5.4 How We Use Consumer Health Data. 

We use the consumer health data we obtain to provide you with the services you ask for and to maintain the safety of these services. We may also use consumer health data to respond to your questions or concerns and to operate the Airbnb Platform. Consumer health data will be used as necessary for legal and regulatory purposes, including in litigation, and to prevent, detect, investigate, respond to, and prosecute activities that violate the law or our policies.

5.5 How We Share Consumer Health Data. 

Airbnb’s vendors may access consumer health data only as needed to deliver relevant services. Airbnb shares health data requested during the booking of a Service or Experience with the provider and any vendors involved in fulfilling the booking. Consumer health data may be shared with our insurers, our professional advisors, and regulatory authorities as required. We will provide consumer health data to emergency personnel when needed to protect health and safety.

5.6 Consumer Health Data Rights. 

Residents of Nevada and Washington have specific rights related to consumer health data. In other states, you may have similar rights under your consumer privacy law. You can exercise any of your rights by contacting us by email at dpo@airbnb.com or by visiting the link here.

6. VERMONT RESIDENTS. 

If you are a Vermont resident, this clause applies to you, and supplements the Airbnb Privacy Policy. Airbnb Payments will not share personal information, financial and non-financial, it collects about you with its affiliates or third parties, except as permitted by your state’s law.

7. HT PERKS PROGRAM CREDITS. 

Participants in the HT Perks Program are eligible to earn Airbnb credits for their HotelTonight stays. These credits will appear in your Airbnb account if your HotelTonight and Airbnb accounts are linked. You can unlink your HotelTonight and Airbnb accounts by emailing help@hoteltonight.com.
