3 Plaintiff and Counterclaim-Defendant Rambus, Inc. (“Rambus”) and Defendants and
4 Counterclaim-Plaintiffs Samsung Electronics Co., Ltd., Samsung Electronics America, Inc.,
5
Samsung Semiconductor, Inc., and Samsung Austin Semiconductor, L.P. (collectively
6
“Samsung”) jointly submit this Proposed Order.

1. Pursuant the August 22, 2008 Order Regarding Pretrial Calendar for September 22,
8
9 2008 Trial, motions in limine and objections to those motions in limine are due on August 27,
10 2008 and September 8, 2008 respectively. Any motions in limine related to (a) any of the
11 parties’ expert witnesses and (b) Rambus’s documents over which it asserts a claim of privilege
12
shall continue to be governed by the schedule set forth in the August 22, 2008 order. However,
13
to account for the discovery of issues that may arise after the exhibit and witness lists are served
14
on August 27, 2008, Rambus and Samsung hereby stipulate and agree, subject to the approval of
15
the Court, that additional motions in limine may be served and filed on September 2, 2008 and the
16
17 oppositions to those motions in limine are to be served and filed on September 12, 2008. These
18 additional motions in limine will be heard at the Pretrial Conference set for September 16, 2008
19 per the August 22, 2008 Order.

2. The due date for the parties’ Proposed Findings of Fact and Conclusions of Law
21
shall be changed from August 27, 2008 to September 8, 2008.

3. The due date for the parties’ optional Trial Briefs shall be changed from August
23
24 27, 2008 to September 8, 2008.
