CENRO Certification for Finality Order

The memorandum requests that CENR officers issue a certification as a supplementary requirement for requests for an Order of Finality regarding confiscated forest products. Under existing DENR policy, an aggrieved party has 15 days to file a motion for reconsideration of a confiscation order. The certification would confirm that the confiscation order has attained finality, either because 15 days have passed since it was received by or posted for the aggrieved party. This additional requirement is meant to promote the absolute application of existing policy and provide benefit to all parties by ensuring DENR laws and rules are properly implemented. CENR officers are advised to use the attached template in issuing the certifications.

SUBJECT : SUPPLEMENTARY REQUIRMENT ON THE REQUEST FOR


ISSUANCE OF ORDER OF FINALITY FOR CONFISCATED
FOREST PRODUCTS, CONVEYANCES AND SAWMILL
PARAPHERNALIA

This is in relation to the requirements for the issuance of Order of Finality for
the confiscated forest products, conveyances and sawmill paraphernalia. Under our
existing policy DAO 97-32, the aggrieved party has 15 days from receipt of the order
to file a motion for reconsideration penned by DENR Executive Director. In case of
abandoned forest products, the Regional Confiscation Order (RCO) is required to be
posted at least three (3) conspicuous public places for 15 days for the aggrieved
party/respondent to file his motion for reconsideration, otherwise the order issued by
RED would attain finality.

Although this office observes that both CENRO’s under PENRO-ADN are in
compliance with the afore-cited policy however, this office believes that a certification
duly issued by CENR Officer should be issued as supplementary requirement
certifying the posted RCO or received by aggrieved party has already attained its
finality. The additional requirement does not contravene to the existing policy but
promotes its absolute application. The said certification would be beneficial not only
to CENR Officers but also to our clients/respondents/aggrieved party that DENR
laws, rules and policy are duly implemented.

Anent to this, you are advised to issue a certification duly signed by CENR
Officer certifying that the received or posted Regional Confiscation Order (RCO) has
attained its finality (pls. see attached suggested template) and the same be attached
to the posted or received RCO as part of the requirements for the request of order of
finality to the DENR Regional Office.
