MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement made and entered into by and between:

BACOOR NATIONAL HIGHSCHOOL TABINGDAGAT ANNEX an educational


institution duly organized and existing under the Department of Education
(DEPED)with business/office address located at ______Tabing Dagat, Bacoor
City________________________hereinafter referred to as “THE INSTITUTION”,
represented herein by its Officer-in Charge, Mr. Ponciano G. Garrido.

private/public, non-stock, non-profit duly registered with (agency/department)
________________with address at ______________________________ hereinafter
referred to as the “EXTERNAL STAKEHOLDERS” represented herein by its
(DESIGNATION), (NAME OF REPRESENTATIVE).

WITNESSETH THAT

WHEREAS, THE INSTITUTION, in the exercise of its corporate social responsibility,


promotes and supports K to 12 education and training and finds the existing program
offering of the Bacoor National HighSchool in line with such purpose as well as its own
student development program and school enhancement facilities.

WHEREAS, pursuant to the INSTITUTIONS objective of improving the quality of


education of its students and workforce through the development of technical ,
educational skills and proper work values/attitudes, the ESTABLISHMENT has
expressed its willingness to partner with the STAKEHOLDERS hereby accept
students, faculty and staff to undergo the required training if needed and or donate the
latter shall, build and extended the necessary facilities , skills and /or financial support
for such students, faculty and the INSTITUTION in itself.

NOW, THEREFORE, for and in consideration of the foregoing premises and of the
terms hereinafter provided, the parties hereby agree to execute this Memorandum of
Agreement under the following terms and conditions:

Section 1. The STAKEHOLDERS and the INSTITUTION shall establish a


partnership under the SCHOOL BASED MANAGEMENT PROGRAM (SBM) and jointly
apply for accreditation with the DEPED Division of the City of Bacoor for the program.

Section 2. As part of the partnership, the STAKEHOLDERS and the


INSTITUTION agree to undertake the following functions and responsibilities:

A. The INSTITUTION shall:

1. Undertake to carry out in-service training for the students, teachers


nominated by the STAKEHOLDERS in accordance with the Training Plan
jointly worked out by the INSTITUTION and the STAKEHOLDERS
following a scheme of upgrading the facilities and within the training
schedule .

Assign personnel to train and guide the students, teachers, make


recommendations regarding discipline and proper behavior and determine
the proficiency of the students and teachers in the specific trade or craft;
2. Provide the students and teachers with the necessary tools and materials
required during the training;

3. Designate/appoint a TRAINING COORDINATOR to represent the
INSTITUTION in all meetings with the STAKEHOLDERS in connection
with the implementation of the SBM and other related concerns;
4. Provide the students and teachers the necessary support whether in
documents or financial to participate in any events deemed necessary by
the STAKEHOLDERS.

B. The STAKEHOLDERS shall:

1. Facilitate the processing of the accreditation of the STAKEHOLDERS and


the INSTITUTION with DEPED and furnish the INSTITUTION with a copy
as evidence of its compliance therewith;

2. Recommend students and teachers who will undergo the training in the
INSTITUTION

3. Designte/appoint a STAKEHOLDER’S Industrial Coordinator who will be


who shall:

a. Meet regularly with the INSTITUTION’S Training Coordinator;

b. Orient the students , teachers and staffs about proper attitude


and behavior to be observed within the company site;

c. Monitoring and evaluating the performance of students and


teachers in the INSTITUTION during the trainings and seminars

d. Conducting monthly visit at the training station/workplace of the


INSTITUTION to monitor the status of the program;

4. Undertake the in-school training by conducting theoretical subjects and


Laboratory practice related to the approved curriculum and Training Plan
Jointly developed with the INSTITUTION;

5. Exercise due care and diligence in the selection and supervision of the
trainees in order that injury, damage or loss of person(s) and property
within the INSTITUTION’S premises will be avoided;

6. Pay the students, teachers and staffs their daily allowance from the
training allowance paid to them by the INSTITUTION;

7. Ensure that the students and teachers undergo competency


assessment after completion of their training.

8. Issue a Certificate of Training to the student or teachers upon


Completion of the training; and

9. In addition to the above, comply with the applicable provisions of the


Republic Act No. 7686 (DTS Law).

10. Check the needed facilities in order to ensure the development of


the students and its workforce.

11. Provide the institution with all the possible help you can extend in
accordance to the STAKEHOLDERS mission vision.

12. Uplift and be a partner in the undertakings of the INSTITUTION

13. Provide the INSTITUTION needed help in the form of


 Financial help
 Scholarships for students
 Additional buildings or facilities
 Multi-media advancement for better information
 Provision for a center for reading and health consciousness
facilities
 Security and Protection against crimes
 Anti-bullying Protection
 Hotline for psychologically distress students and teachers
 Any form of help that may be necessary for the INSTITUTIONS’
progress and development.

NOTE: Any other arrangements between the STAKEHOLDERS and the


INSTITUTION may be added.

Section 3. The STAKEHOLDERS and the INSTITUTION further agrees that for
the duration of this agreement the following must be observed:

1. There is no employer-employee relationship between the


INSTITUTION and the STAKEHOLDERS. Neither is the
accommodation given by the INSTITUTION in allowing the
STAKEHOLDERS to be considered as a guarantee for employing the
workforce of the INSTITUTION in any program or event not in line with
the INSTITUTION’S mission vision.
2. The STAKEHOLDERS are not obliged to pay the students, and
teachers compensation of any kind, other than the grant of the training
allowance during the training/seminar herein elsewhere provided;
3. The students, teachers and staffs and the STAKEHOLDERS shall
abide by the INSTITUTION’S rules and regulations and with those
imposed for the program, otherwise, they shall be excluded from
further participation therein;
4. The INSTITUTION reserves the right to refuse acceptance of any
students or teachers nominated or recommended by the
STAKEHOLDERS and discontinue the training of any such trainee on
reasonable grounds after 10 days written notice to the
STAKEHOLDERS;
5. The STAKEHOLDERS may pull-out any students and /or teachers from
the INSTITUTION on reasonable grounds after it has sent a 10 days
written notice of such pull-out;
6. The STAKEHOLDERS may extend the support for students , teachers
and the INSTITUTION itself, upon the approval of the
STAKEHOLDERS,themselves.

Section 4. That all business and technical information, data, software and related
documentation, in whatever form provided, recorded or unrecorded (hereinafter
collectively referred to as “ information”) which the INSTITUTION may furnish or has
furnished the STAKEHOLDERS shall be:

1. used solely for the purpose for which it was furnished;


2. treated in strict confidentiality and the students/trainees cannot without
the consent of the INSTITUTION, be examined as to any
communication made to them in the course of training;

3. not be reproduced, except as necessary for its authorized use; and
4. returned (if in tangible form) together with all copies thereof when
demanded by the INSTITUTION or when no longer needed.

Section 5. This Agreement shall take effect on _____________ and shall


continue to be in effect unless terminated by either party by giving the other party a
written notice of its intention to terminate the Agreement at least thirty (30) days prior to
the intended date of termination. Any provision of this Agreement may be amended
only with the written consent of both parties herein.
